Fair use allows limited use of copyrighted material without permission from the copyright holder for purposes such as criticism, parody, news reporting, research and scholarship, and teaching.

In the court of law taking a system that is copyrighted, making changes to it and releasing it as your own version could certainly fall under fair use.

Generally true, except in a case where someone is clearly threatening to publish it. If the material was published as it was received, and it went to court, Andre would win. But win what? The sale price is low, and he would have to establish lost revenue. It just wouldnt be worth anyone's time to bother with legal action.

Releasing a principle or process (system) is protected by Intellectual Property laws. Merely changing a few things doesnt protect the person unlawfully sharing it. The ramifications are much the same as copyright law. I know the laws behind it quite well, but in the end with everything considered, nothing is going to happen if Andres strategy is shared.

Anyway I dont see the legal side of it as an issue. It's more a moral side.

RG you criticize his method, but you give credit to strategies that are probably no better. The fact that this strategy is being sold does not change that.

Quote from: Madi on Aug 06, 08:08 PM 2018Do u have any proof that its has cooyright? Or just his word.

Madi, copyrights dont need registration. That's just a formality. It may vary between jurisdictions, but last i checked there was an international treaty for it.

But again this is not really a matter of is it copyrighted. It's more a moral issue.

The way I see it:

1. The strategy probably is no better than most. But it's still intellectual property.

2. The buyer assumed a risk in purchasing. If Andre clearly stated no refunds permitted, then the purchaser should assume the responsibility. If Andre said refunds would be provided, then he should honor that.

3. If the system is an outright scam, then shame on Andre, and shame on the purchaser for believing it. There are tonnes of systems being sold. You will find good and bad feedback for any of them. Still if its a scam, then of course the purchaser should have a refund. So what defines it as a scam? In my view, false promises like "it never loses".

Anyway I'm not a judge of this. I dont know what Andre's description of the system and promises were. Maybe escalate the claim to paypal.

My point Steve is let the scammers cry

They can throw around the word copyright. But fact is it means little when you modify it and share your results

Fair use

Leave it up. Show the forum you allow system sales

But let’s slap him around

Steve

Accusing someone of being a scammer is pretty serious.

If he is scamming people, then he deserves flak. But if he isn't scamming people and you're busting his balls, then you would be the problem. I try to steer away from judging because accurate judging would require all the facts from both sides. And besides I dont have time for it. Unfortunately though, I'm forced in the middle because I dont want to allow scamming, and I dont want to allow unjust attacks.

It would be simpler for me to say: if you're going to buy something like a gambling system, approach with extreme skepticism. And don't be surprised if the system doesn't work. It's the buyer's risk. Don't send money then complain about it later. It's your own fault for sending money.

As far as i'm aware, Andre has both good and bad feedback. Just like you get good and bad feedback when someone here tries a new system of any kind, free or not. There are winners and losers even with random bets. It doesn't mean the system works.

I don't want to allow scamming if its very clear. I want to allow people to sell, but not if its a blatant scam. Buyers should also be responsible.

So please summarize exactly why you believe he is scamming. Specifically quote his exact words, to show he falsely represented his product. If you arent going to substantiate your allegations clearly, then please stop attacking Andre.

I've been on the receiving side of unjust criticism. And I've been scammed before too. So I understand both sides. I'm trying to better understand what's really happening, so I know what is fair or not from a moderation perspective.

its not so much of an issue of him scamming

its an issue that he is selling a product that is in line with many system people share for free

its an issue of him (one year ago) being a newbie and asking others to share methods with him

this is not a forum member

this is someone looking to profit off other member since day one...he waited a year...

like i said, i think you should leave it up...but we are gonna slap him around

i use proofreaders as an example...why? because we know what we get...no false claims...hes been around for years...that is fine...this guy is just looking to use us

THANKS STEVE!

You took the risk of buying strategy. If you did not like it, if the strategy don't fit your play style, I'm sorry but you took the risk.
If you reveal the strategy you will be disrespecting everyone who has bought it.

I'm providing an efficient strategy.

It took months of study so I could create the strategy.

If you share it you are disrespecting me and disrespecting all the players who has purchased it.

Again, I'm not a scammer! I'm providing an efficient strategy.

even if you found a "bust" for D.A., this doesn't mean that it's not a winner
as AC always said, the important thing is that it wins more than it loses
I tested 400 shoes and busted 2 times and? I won A LOT more than lost
this is it

This is Andres claims from this forum.I am -21 units after 2 sessions.

Hi,

Yes just 15 units

The wait for the trigger is not long. It can take about 5 to 20 minutes to play in online casinos and trackind more than one table

A lot of people asking me the win rate.

100%

I will said it again. I never lose playing the strategy.

I have no reason to lie.

Quote from: RouletteGhost on Aug 06, 08:41 PM 2018its not so much of an issue of him scamming

Thats not scamming. And there are clearly people saying they are happy with the strategy. Understand I'm not taking sides here. I'm just trying to maintain the balance.

Quote from: RouletteGhost on Aug 06, 08:41 PM 2018its an issue of him (one year ago) being a newbie and asking others to share methods with him

I understand your points, but those alone don't justify calling someone a scammer.

Quote from: RouletteGhost on Aug 06, 08:41 PM 2018this is not a forum member

Selling is allowed. the only exceptions are if they are spilling sales material into areas outside the sales section, or if there is clearly more negative than positive feedback, indicating it may be a scam.

Quote from: RouletteGhost on Aug 06, 08:41 PM 2018like i said, i think you should leave it up...but we are gonna slap him around

You can give justified criticism, but not troll him.

Quote from: RouletteGhost on Aug 06, 08:41 PM 2018i use proofreaders as an example...why? because we know what we get...no false claims...hes been around for years...that is fine...this guy is just looking to use us

Has proof ever sold or advertised a strategy? It would be ok if he did anyway.

I asked you to explain what Andre's false claims are, that would justify calling him a scammer. You didnt provide that information. So I have nothing that indicates he's a scammer, or that he would need to be banned or moderated in any way.

I get your points RG really but understand my position and needing to be Switzerland.

-21 units after 2 sessions is not a fair test, unless he claimed to win every session.
